| The dissertation illustrates some fundamental theories on legal protection forarmy, on basis of its concept, indicating that the military activity should beregularized and oriented by law, which is the practical experience from the militaryjural construction in China.China’s law guarantee has developed into a peculiar system through Thousandsof years of continuous theory exploring and empirical inspecting. It provides richreferences for future exploring on legal protection of diversified military missionsfor Armed Police Force in this new era.The armed-police law that specifies the authority,procedure and guarantee ofdiversified military missions for armed police,was passed by the10th meeting of the11th National People’s Congress in August2009. Seen from the status in quo aboutlegal protection implement by armed police,some problemsdisconnected with thetime and situation,are still unsettled,such as the boundary ambiguity of military missi-ons,the Inefficiency of troops’ mobilization and command,the mismatch of enforce-ment power and enforcement itself,the lag of facilities and material logistics and soon. All these problems restrict the armies from performing their duty successfully toa great extent. By taking the theoretical analysis method, the problem profilingmethod and comparative analysis method, this article is the integrated use ofsociology, management science, law and other discipline theories. Based on acomprehensive, objective analysis of the deep-seated reasons, this article haveconducted in-depth summary and thinking, range from the necessary of the ArmedPolice Force legal protection, new requirements under the new situation, the basicprinciples and basic ideas, to the practical obstacles encountered in theimplementation of the Armed Police practical tasks, Providing the factual basis andthe main countermeasures for the study of the development and design of the workof the legal protection of the Armed Police Force. |
