| Online group shopping is gaining popularity over the world for its low price andconvenience in the last few years. While it is being convenient to consumers, it is bringingvarious issues, which manifest as consumer offences. Because consumers are of doubleidentities of online e-commerce ones and virtual ones, the adaptive substantive laws andprocedural laws to this sort of dispute are more complex. Due to online group shoppingbeing a new-born thing and hysteresis of legislation in our country, consumer protection maynot be fulfilled in efficiency. A cogent and effective protection mechanism is intended toestablished focusing online group shopping consumer protection for the sake of healthdevelopment of network market and effective protection of consumers’ rights. Exceptintroduction and conclusion, this thesis is divided into four parts in analysing online groupshopping consumer protection. The first part is basic research of online group shoppingconsumers, which includes the analysis of the conception and features of online groupshopping and comparisons between online group shopping consumers, traditional consumersand online shopping consumers to search for the particularity of online groups shoppingconsumers. The second part is an description of current situation of our country’s protectionlegal system on online group shopping consumers and analysis of issues which cause weaklegal protection of online group shopping consumers including outdated legal systems, lacksof market supervision and few laws that the judicial can rely on. In the third part, the authorabsorbs various methods in solving disputes online without suing, consumers homejurisdiction, small claims, etc, based on introductions and analysis of consumer protectionmechanisms in the U.S., the E.U., Australia and Japan for the sake of providing references toimprove online group shopping consumer protection in our country. In the fourth part,according to discussions and arguments of three parts above, the author try to advancesetting up several states to ensure online group shopping consumers’ rights as strict withmarket access, confirming locations of plaintiffs, margins compensation in advance, etc. |
