Research On The Perfection Of The System Of Consumers Withdrawal Right In Online Shopping

On the basis of a deep summary of the previous legislative experience and practical experience,the law on the protection of consumer rights,which began to be implemented in March 15 th,2014,gives consumers the "right to withdraw",which is a new breakthrough in the way of consumer protection in China,and is also the important embodiment of our country's legislation to keep in step with the international advanced legislative technology.However,there are many "ineffective" phenomena in the practice of the system introduced from abroad,such as the unclear scope of the application of the right to withdraw,the unclear specific conditions for exercising the right,the abuse of the right of withdrawal of the consumers,and resulting the "countermeasure behavior" by the operators.In addition,there are disputes in the theoretical circles on how to define the right in nature,how to justify the existence foundation of the system and what kind of legislative mode should be adopted in the system.They all need further explanation and illustration.In view of the problems mentioned above,the legislation should further define the scope of the application of the right of withdrawal of consumers,clear and refine the conditions for the exercise of the right of withdrawal.The administrative organization for law enforcement should effectively regulate the behavior of the consumer abusing the right of withdrawal and the "countermeasure behavior" of the operators.At the same time,improving the system of the withdrawal right of the consumers in the cross-border online shopping in the legislative level,to provide more reference when improving the system of consumer withdrawing rights in the future.And through the discussion of the above problems,the application of the system for the withdrawal of consumers in our country will be clearer.
