Study On Legal Problems Upon The Intermediary Services For Work Safety In China

The work safety intermediary organizations and Services are playing a moreimportant role in safety accident prevention with technical methods. Function-Change ofgovernment and work safety supervision needs the participation of social intermediaryorganizations. This study is good to solve the legal regulation problems on the work safetyintermediary services, to meet the revision of Law of the People’s Republic of China onWork Safety, to promote the improvement and running of safety law system ofintermediary service, and to guide the intermediary services for work safety to carry out inorder. With the methods of literature research, textual analysis, social investigation andnormative analysis, this paper analyzes problems existing in the work safety intermediaryservice institutions in China and find a series of problems in legal regulations on worksafety intermediary service, including legislation, compliance and law enforcement，solegal regulations are poor. This paper proposes to introduce legislative amendments to the“Law of the People’s Republic of China on Work Safety, to legislate the Regulations of thePRC on the work safety intermediary organizations、the Regulations of the PRC oncertified safety engineer and the Administrative measures of the PRC on Certified safetyengineer office. In the end，this paper puts forward to improving the production safetyintermediary services market access legal system，the supervision system and the dutysystem, to raising the level of compliance with laws of work safety intermediary servicesand to improving the supervision and law enforcement on intermediary services for worksafety.
