The Research On The Local Legislative Issues Of Work Safety

Work safety, is the major premise safeguard of social stability and prosperity in all walks oflife.Local legislation in work safety is mainly from the local level, combined with local actualsituation, put forward suitable for the process of laws and regulations of the actual situation inthis region.In this paper, we use the method of literature research, comparative analysis andempirical analysis, to deal with the legal problems of local legislation in work safety of ourcountry. In this area, we find a series of issues such as the conflicting with other laws, a lack ofoperability in local legislation and a lack of character. The main cause of these problems includethe superficial understanding of insufficient work safety system of legislative interpretation withthe local legislative subjects, the mechanical understanding of the principle of ‘nocontradict’,there is no regular cleaning mechanism in this area and a lack of correctunderstanding on the functions and role of the local legislative in work safety.To solve aboveproblems, a series of countermeasures is put forfward，such as to strengthen the research work infront the program of local legislation of work safety, to improve the operability of the locallegislation of work safety, to highlight the characteristics of local work safety legislation and toimprove the review mechanism and cleaning mechanism of the legislation.
