China is a country that the resource of labor force is inversely proportional to the numberof the number of jobs, employment discrimination in China seems to have been a quitecommon phenomenon. twenty years ago, employment discrimination in China society did notcause much attention. But today, the employment discrimination has become the questionwhat China’s society have to face: from the health discrimination of patients with hepatitis Bto the discrimination of height, from the discrimination based on age to the discriminationbased on regional, from the discrimination against pregnant women to the discriminationagainst identity, employment discrimination has been omnipresent. In recent years, familyorigin discrimination also enter our field of vision, the people who holds the power to seeksome official appointment for their families by privilege, it damage equality of treatment andopportunity between the person, and it also violated the equal rights of other employment, butalso will affect the development of social justice, social stability and social economy. Atpresent, how to prevent the employment discrimination in family background, how to realizethe social justice, has become a common concern of our society. Therefore, Exploring thebackground of family discrimination in employment is important.This analysis use the method of theory and practice to probe the discrimination existed inthe employment of China family origin. This paper firstly defines " family origindiscrimination ", and describes the current employment of family background discriminationform. On this basis, the author from the historical, legal, institutional, social aspects analyzesthe reasons for the existence of family background discrimination in employment. Then, theauthor clarify the importance of the prevention of family background discrimination from thefamily of origin discrimination of adverse effects on social equity, social stability, theallocation of resources and so on. Finally, the author puts forward the preventive family origindiscrimination policies and measures from the three aspects of law, system, idea by summingup the history of our country and foreign relevant prevention family origin discriminationsystem and according to the reason of our country’s family background discrimination.
