Community Correction Of Juvenile Delinquency And Social Work

Juvenile is a special social group, Juvenile delinquency in recent years showing a trendof younger age, how to deal with the problem of juvenile delinquency become the trouble ofvarious countries in theory and reality. The particularity of the minors determines the differentway to be taken in dealing with the problem of juvenile delinquency, such as trial minors byjuvenile court without public trial、the legal representative of minors should be notified to thescene、 the minors should be statutory or discretionary lighter punishment when they areconviction and sentencing. Compared to the punishment of juvenile delinquency, how tore-integrate into the society after the minors take the penalty is a real thorny issue. For thedelinquency of minors, China has been pursuing the principle of “fucous on education,supplemented by punishment”. Since2003the national pilot implementation in China,community correction has gone through ten years. After absorbing the advantages of theforeign community correction system and adding some Chinese local elements,thecommunity correction popularizes in the whole country have the real possibility--《Amendments (viii) to the Criminal Law of the People’s Republic of China》expresslystated community correction in the year2011. This is also a positive and useful attempt forthe legislation in the context of mitigation of penal. But compared with the juveniledelinquency community correction system in some developed countries, there are manyproblems to be solved in juvenile delinquency community correction system of China,especially at the micro level of the juvenile delinquency community correction in operation、management mode, such as how to specific implement the juvenile delinquency communitycorrection; how to locate the social worker as a community correction staff; how social workplay a important role in the community correction.Social work in China today is a novelty,although social work has been developed formore than20years in China,for the average person, social work is a very strange concept. Inthe “Administrative”China, it is the government who under the overall sales of the variety ofsocial affairs, so it’s very difficult for the social workers to play their due role. But with thedecentralization of the government agencies to some of the social and public affairs, variousof NGO involve the social and public affairs play a multiplier effect. In the area of thejuvenile delinquency community correction, correctional institutions transfer more correction affairs to social workers may bring better effect.This paper consists of four parts: part one is the responsibility age and the specialreasons of the juvenile delinquency, through the exploration of the special causes of juveniledelinquency, leading to the necessity of community correction applied to minors crimeprevention.Part two is about the community correction of juvenile delinquency, introduce what iscommunity correction、 the objects of community correction、 the values and concepts ofcommunity correction、the Shanghai mode and the Beijing mode of community correction inrecent years and and importance of community corrections applied in juvenile delinquency.Part three is about to learn to the extraterritorial juvenile delinquency, including thecommunity correction systems of U.S.A, Japan, German and Hong Kong, looking forward toproviding useful lesson to us.Part four is about the social work in community correction of juvenile delinquency,including the importance of the social work in community correction and the use of socialwork in community correction of juvenile delinquency. In this part the author mainly analyzeshow the social work organization、the methods of social work and the social worker play animportant role in community correction of juvenile delinquency.
