Reasearch On Enforcement Mechanism Of EU Food Safety Regulations

In recent years, several domestic cases of food safety incidents have aroused publicattention, and food safety rapidly becomes the primary issue of concern. Food security isone of the premise elements which protect human life and health. Only dealing with theissues of food safety, can we promote continued economic growth and maintain socialstability. Due to the frequent occurrence of food safety incidents, a series of food safetylaws and regulations have been promulgated in China, and they are improvedcontinuously in practice. In2009, the “Food Safety Law of the People’s Republic ofChina” was promulgated so as to eliminate illegal and criminal behaviors in food safetyfield and achieved certain results. However, it is still difficult to solve the problems offood safety thoroughly under current legal system, and the main reason of suchdifficulties lies on the defects in current legal system of food safety, which make theimplementation of responsibility and the crackdown on illegal and criminal behaviorsimpossible, and the existing distance between the legal system of food safety and theenforcement mechanism.In the implementation of food safety regulations, EU has maintained a leadingposition. With nearly50years, EU has established a practical enforcement mechanism offood safety regulations covering the food chain "from farm to table". China can learntheir advanced experience, combined with the actual situation, to further improveenforcement mechanism of food safety law, so as to promote economic and socialdevelopment.This article is intended to elaborate enforcement mechanism of EU food safety asthe starting point for analysis research, and it is divided into four parts. The first part,starting from the basic concepts related to food safety, clears the research scope and thenecessity of research in this paper. The second part, from the perspective of legal system,describes the contents of enforcement mechanism of EU food safety regulations in detail,including the basis for enforcement mechanism of EU food safety and institutionalsettings. The third part, in the case of horse event which ocurred recently, interprets RiskAssessment, Food Traceability and RASFF. The fourth part, on the basis of the analysisof EU food safety regulations enforcement mechanism, researches on the influence. We take advantages of the success of EU food safety enforcement mechanism and combinewith the reality to improve our enforcement mechanism.
