Food is the basic material resource of human survival and reproduction related to thefood security of millions of people’s vital interests. In recent years, the frequentoccurrence of major food safety incidents constantly has sounded the alarm on foodsafety issues. And seriously today the national trade becomes more frequently, a countrywhich has food safety issues will affect other countries in food security, and evendevelops into an international food safety incident. So food safety has become a globalproblem focused that public concern. However, since food safety is a broad matter withhuge range of management and comprehensive factors, every country which faced withfood security crisis will be under great pressure. Further study of food safety andtransnational regulation is significant.Food safety of import and export in China has experienced the transition from thequantity to quality. The regulatory agencies and functions of food safety are graduallyintegrated to the current “sub-regulation based, full supervision supplemented”regulatory regime. However, compared with developed countries in this side, no matterthe institutional settings, the functional division, the laws and regulations, we have a lotof deficiencies.The paper analyzes the issues that International Committee on Food Security and WTOsupervise, describes the successful experience of the U.S. and the EU, and presenttargeted recommendations on the basis of a brief analysis of the deficiencies in theimport and export of China’s current food safety regulatory.Overall, this paper consists of preface, body and conclusion. Text is divided into fourparts: The first part defines the concept of food security and food safety transnationalregulatory environment under international law, and analyses the necessity ofcross-border supervision; the second part describes the main legal basis of transitionalregulation of food safety. At first, analyses the regulations of WTO’s SPS Agreementand the TBT Agreement on trade in food safety. Then briefly introduces the CodexAlimentarius Commission and its standards on food safety; The third part presents thelegal system of some countries (mainly the United States and the EuropeanUnion),import and export food safety regulatory agency, and summed up the success ofthese countries’ supervisory experience, providing reference for China Import and Export food Safety Supervision; The forth part analyzes the current status of China’simport and export food safety regulatory and problems, learn from the experience ofdeveloped countries, and put forward a sound proposal.
