Research On The Legal Protection For Child Welfare Rights

The right to children's welfare is a basic right of children,and it is the guarantee and service provided by the nation and society to meet the needs of children's survival and development.At present,China's child welfare system does not match the current situation of high-speed economic development,and faces the difficulties of incomplete legislation,imperfect administrative system and imperfect judicial guarantee.It is difficult to meet the needs of children's growing welfare,and the right to children's welfare is in a state of emptiness.Improving the legal protection of children's welfare rights is not only a sign of the process of national legalization,but also the reflection of economic,cultural and humanistic concern's development of a nation.Some of the outstanding experiences in the legal protection of children's welfare rights in other countries are of great significance to the development of the legal protection system for children's welfare rights with Chinese characteristics.With the development of China's economy and social progress,China has made remarkable achievements in improving the legislative protection,administrative protection and judicial protection of the legal protection of children's welfare rights.As far as possible,in every aspect of legal protection,we should safeguard the interests of children and ensure the realization of children's welfare rights.At the same time,the development of society has brought wider attention to the welfare rights of children.A higher level of the concept of children's welfare rights has entered the public consciousness,so the legal protection of children's welfare rights has also put forward higher requirements.In recent years,the speed of China's economic development has been amazing.It has grown from a large agricultural country in the past to a newly developing industrialized country with high speed development,and is making a spurt to a modern power.Accordingly,the social security system has also developed rapidly,but children's welfare right is relatively weak,and needs more attention from the state,society and people from all walks of life.The current welfare system for children in China is a typical compensation system,not a guarantee and maintenance of children's welfare rights.Further improving the legal protection system for children's welfare rights is conducive to the construction of children's welfare rights,and fundamentally ensures the realization of children's welfare.It enlarges the coverage of children's welfare,increases the service items for children's welfare,and improves the standard of children's welfare.We should adhere to the principle of giving priority to children,take the law as the main driving force,take a sound administrative system as the safeguard,and take judicial means as a relief guarantee.Only enacting systematic and diversified implementation mechanism,can we truly protect the dignity of children,promote the happiness and benefit of children,and promote children to develop freely and comprehensively in order to achieve the fundamental goal of benefiting more children and families.This paper suggests that we should carry out reforms in three aspects of legislation,administration and judicature,combine our current system and social concept and draw on the excellent experience of other countries,establish the children's welfare rights legal protection system with a comprehensive legislative system,a perfect administrative system and a sound judicial system,in order to ensure the realization of the right to children's welfare in China and promote the process of legalization in China.
