The establishment of community correction rule in our country is a reform andinnovation of our country’s way of penalty execution. Community correctionoffenders are the core element of the community correction. Carrying on the empiricalresearch can objectively reflect the implementation of community correction rule inChina. On the basis of investigation on community correction in China, the authorcarried on the quantitative and qualitative analysis. Some features were found infollowing specific performance such as a great number of community correctionoffenders in our country, a low crime rate again. And the probation was the main type.Crimes are widely distributed in disrupting social management order crime. As aresult, they were managed by the sort. In addition, on the one hand, communitycorrection offenders have a great change in thinking by the education. Theirpsychological barriers were eliminated. They enjoyed the basic guarantee of life. Atthe same time, compared with imprisonment offenders, community correctionoffenders enjoyed greater freedom in our country and had the obvious enhancement ofhuman rights protection. On the other hand, community correction offenders in ourcountry had been keenly felt the deterrence of criminal law through the investigation,prosecution and trial procedure. So it did not break the severity of the penalty to applycommunity correction for offenders. Therefore, from the point of view of specialprevention, the implementation of community correction for community correctionoffenders had played an important role in preventing committing a crime again. Whenchallenged with the community correction that reduced the punitive penalty orreduced the effects of the general prevention, all kinds of thoughts and behaviors ofcommunity correction offenders are given a negative response. On the whole,compared with imprisonment correction, community correction both preventedcommitting a crime again and protected human rights. Our country should continue toimplement the rule, and improve community correction laws, regulations and othernormative documents to gain the new breakthrough in the new period.
