An Empirical Study On Community Correction Of Juvenile Prisoners

In recent years,with the development of the society and the improvement of people living standard,the earlier physically maturation of teenagers along with the rapid development of network information,teenagers suffer more unhealthy thoughts than before,which creates the trend of a crime appearing younger at present,the rising number of juvenile crime cases,and the more serious in the juvenile crime.Because of the special nature of the juvenile group,juvenile crime and the treatment for juvenile crime has become one of the focusing on problems in today's society.Community correction is a great innovation of the penalty execution system,conforms to the current democracy rule of law in our country and social development,and also conforms to the current policy of "tempering justice with mercy" and "give way" of our country.Community correction promotes the reintegration of correction offenders and social,prevents criminals from committing,improves the awareness of crime prevention fundamentally,and resolves social contradictions to promote the good will of the entirely social harmony.The system of community correction for Juvenile inmates has become a legal system,accepted by internationalization and approved by the state,the implementation of which can not only play a preventive effect on crime again,but also creates paths for minors to walk into society,which accords with the requirement of a harmonious society and standards.But for the starting late of system of community correction in China,some problems on the community correction for juvenile criminals need to be solved.Judicial offices,the most direct participants and implementers in community correction,still exists many needs to improve.Through the accumulation of literature and on-the-spot investigation and study,with the actual conditions of community correction in primary judicial offices,this research mainly expounds from the following several aspects:First of all,this paper expounds background and significance,summarizing the innovation and deficiencies.The policy of juvenile crime,“education protection is given priority to;punishment is complementary”,has always been sticking to in our country,and community correction adopts the way of non-custodial,pays attention to the education and reform of juvenile criminals,which is a very appropriate way of penalty,so study of related problems is great significance.Then,the second part discusses and analyzes the status quo of community correction and the theory.Community correction system in some western developed countries has a long history.According to their different national conditions,they have their own characteristics,which have a very good reference value to the work of community correction in China.Although the community correction in China starts late,it develops rapidly in recent years.This article analyzes the domestic and foreign situations and related research works,clears the concept,background,meaning,task,function and participants of community correction in this study,and lays a theoretical basis of community correction for juvenile criminal.In the third part,based on the field investigation and the actual work of the author,this paper analyzes and discusses the community correction of juvenile delinquents,and takes the actual correction and management of juvenile delinquents conducted by the judicial institute of T city D as an example.Based on analyzing the basic situation of the community correction work in D judicial office,which includes the basic situation of community inmates managed by primary judicial office and judicial officers working for community correction,this paper investigates and elaborates the principles and methods of correction to the juvenile criminal,and shows the whole process of community correction for two juvenile delinquents,affirms the achievements of the community correction in the juvenile criminal,and provides the demonstration and reference for the judicial offices on juvenile criminal correction.But at the same time,through the practice of community correction in D judicial office,this paper sums up many problems such as lack of legal support,limited working mechanism,low social recognition,imperfect of the personnel and so on.Then,this paper analyzes the existing problems to find the reason of these problems.In the fourth section of the research,in order to promote the related research in practice of community correction for juvenile criminal,helping the community inmates return to society,this paper puts forward my own ideas and suggestions in five aspects,such as in the legislation of community correction,the improvement of minor modification project,the establishment of professional correction team,the exploration of correction center model,the organization of social forces to participate.Due to the good representativeness of D judicial offices in the early established time of community correction work,rich experiences,large amount of the community inmates,this paper mainly chooses it as an example.Because of a large number of legal issues involved in the research,the author also cites some legal provisions in order to rigorous.At Last,with the background of administration the state according to law as,the author hopes to makecontributions to the research of correction for the juvenile criminal.
