On The Legal Protection Of Network Privacy Right

People nowadays are quite easily to access to the internet in china due to the widespread of the computer. It is quite convenient for individuals to be well informed of what happened around without other physical materials. However, the internet might contribute to illegal privacy disclosure issues as well. In the information overload era, the law protecting the civic privacy against the abuse of the internet is highly demanded. This article intends to investigate an efficient way to protect the privacy online at home based on the privacy protecting model developed countries applies.This paper includes five parts. Before conducting further investigation, this paper do literature review on manpower search initially, covered in the introduction part. Then, concepts in law about this area and the main ways of network privacy right tort are specifically illustrated in the first part of this paper. Moreover, the paper tries to do jurisprudence analysis on classic manpower search cases. To make the analysis as objective as possible, the exceptional cases on manpower search are highlighted as well. The third part investigates the bases of status quo of current privacy protecting model applied by foreign countries, i.e., American model, European model, to found the basic thoughts about how to choose most efficient privacy protecting model fitting for our current situation and also some thoughts about legislation. Eventually, The paper illustrates the online privacy protecting methods and some proposals about setting online privacy protection act for society are made, embodying proposals on field of norms and non-norms.
