The Proposals For The Legislation Of Shenyang’s Wetlands Protection Regulations

As one of important economic resources for human society, the wetlands have powerful function in ecology, economy as well as society. The integrality of wetlands can produce great impact on city development and ecology safety. In accordance to legislation tendency of wetland protection, this thesis attempts to give suggestions to the legislation of wetland protection regulations adapted to Shenyang with the legislation of Shenyang’s wetland protection as research subject.Chapter one is the introduction to the legislation background of Shenyang’s wetlands protection which analyzed the current situation of legislation of China’s wetlands protection and presented the legislation resources and principles for Shenyang‘s wetlands protection. Nowadays there is no nationally special legislation on wetlands protection or special protection on the whole wetlands as protection subject, local legislature has opened the history of special wetlands protection legislation. Many provinces and cities in China have carried on the special legal protection on wetlands. The legislation resources of Shenyang’s wetlands protection regulations lie in the local legislative power and legislative programs of Shenyang from 2013 to 2017. Lawmaking must follow some principles; that is, adhering to the basic principles of legislation in accordance with the laws, adhering to the basic principle of "do not contradict and be distinctive" and making scientific and democratic legislation.It is necessary for making special laws because of wetlands’ great function in one city’s development and its current situation and characteristics. As good environment can form positive prerequisite and foundation for one city’s development, the wetlands, one of important environmental resources,can provide the cities with water, purify the air, store flood for drought-resisting, regulate regional climate, and maintain regional ecological balance, etc. Shenyang owns vast and various wetlands, but some of them have been through severe damage. For effectively protecting these wetlands, special protection regulations in Shenyang are necessary. The feasibility of special wetland protection regulations in Shenyang is showed in many ways, such as the practical basis of legislation for protecting wetlands in this city, the guidance for related legislation, the legislative experiences from other cities, the city’s emphasis on wetlands protection and so on.On the basis of the two former chapters, this thesis proposes suggestions for the legislation of wetlands protection in Shenyang. The pattern of this thesis is showed as follows: laws and laws’ statement the explanation on the reasons for legislation and legislation examples. This proposal is divided into five chapters: the first chapter is the general and the second one is the management, which are followed by supervision and inspection,the legal responsibility and the bylaws.
