Research On Perfecting Legal System Of Wetland Protection In China

Wetlands as an important part of Earth's biosphere, its ecological and economic values are increasingly familiar to people. Wetland area is shrinking rapidly, the ecological crisis-prone embarrassment, therefore more and more people fervently hope to protect wetlands by improving its legal system.China is a country of wetlands, wetland type variety. According to the State Forestry Administration in 2012, latest survey figures show China's forestry situation,the national survey of wetland resources results shows that our existing 100hm2 per cent of the wetland area of 38.48 million hm2 in all, ranking first in Asia and fourth in the world. The per capita natural wetland area of 0.028 hectares, equivalent to only the world average of 13.15% wetland area. Compared to the legal protection of objective reality, development and utilization of the forest and the ocean has better legal protection. However, as the third of the earth's ecological system of wetland is still at the level of local regulations, not up to National Wetland Legal protection. The reason why legal protection of wetland are in grim situation is that the lack of national legislation, moreover the difficulties of wetland legislation process, such as the accurate definition of legal definition of wetland, wetland property, the existing management of wetland protection and wetland system conflict and so on.On the one hand, the author will be sorting out the legal system of wetland protection in China, besides summary and analysis of the legal protection of the wetland in China dilemma. On the other hand, this article learns from foreign legislative advanced experience of wetland through the introduction of International Convention on the protection of wetlands and the wetland protection legislation experience of some wetland national. Author thinks that perfect China wetland protection legal system should consider following several points. Firstly, our state must establish the special wetland protection law. Secondly, the legal concept and denotation of wetland should be accurately defined. Thirdly, overcoming existing administered, and complex of wetland resources management mode, as of straighten out and established unified of wet-land. Last, construction of public participation system, with the legal compelling force to ensure system operation.
