Studies On The Legislation Of The Chinese Wetland Protection

The Chinese word "shidi" comes from the English word "wetland".It means the wet lands,refers to a kind of special land resource and environment of living beings.It is wisely dispersed all over the world.It has very high economic,ecological and social value.China is rich in wetland resource.But for a long time,the value of wetland is unknown to mankind,In the protection of wetland,there are many problems such as sharply deteriorating wetland environment,over-utilizing resources, damaging creature's diversity,increasingly aggravating pollution,and weakening wetland functions,which all result from irrational exploitation of wetlands.This situation goes against the principle of sustainable development strategy in China.After China has joined "the International Convention on Important Wetland in Particular Habitats for Water Poultry" in 1992,short for "Ramsar Convertion",the protection and exploitation of wetland resources is one of the lastest issues in our country.It is also a subject covered by the law of environmental protection.It is an essential way to solve this problem by legislation and regulate men's behavior on exploiting,using,protecting and managing wetland resources by the form of laws and regulations.Our country have made few researches on wetland resources legislation by now,furthermore these can not meet with the strong demand on laws and regulations which are related to protection of wetland in our country.This article reveals the crisis of wetland resource in China and refers to research law,environment law and using the experience of research results both in our country and foreign country.In the main part of the article,there is an discussion about a series of problems on the legislation involved resource protection and utilization,such as the model of the legislation,the principle of the legislation,the institution exploration and suggestions in establishing and improving the specific law for protecting wetland.
