Study On The Administrative Law Enforcement In Village Highway Of Gansu

Road administrative enforcement of law is an indispensable part of the road public administration, which is also the important portion of the implementation of the administration by law. Its efficient enforcement could clarify the subject and object of the law enforcement, which is favorable for the smooth transportation, regulation and safe use of the roads in our country. The main basis for the administrative law-enforcing department and law-enforcing personnel to carry out road administrative enforcement of law is Road Act and its relevant laws; the main policy basis is the requirement in Outline for Promoting Law-based Administration in All-around Way by the state council; it aims for implementing and executing road administration fully and precisely through promoting the efficiency and management benefit of the law enforcement, by which could guarantee and maintain normal order of road traffic. Road administrative enforcement of law is an indispensable part of the road public administration, while the road public administration is the valid expansion and specific pattern of manifestation of the government administrative power in this special carrier of road social relationship. All of these prove the necessity of the research on the road administrative enforcement of law management.Based on this and based on large amount of learn and studies, the relevant issues existing in rural road administration and law enforcement in Gansu Province is studied, explored and analyzed. Firstly, the literatures on rural road administration and law enforcement at home and abroad is combed and inducted; secondly, the meaning of road administrative enforcement of law is well defined, its characteristics are presented, and the theoretical foundation of the road administrative enforcement of law is presented; thirdly, the current situation of the rural road administration of Gansu Province is described, and the existing issues are analyzed through subject and institution; fourthly, the meaning for the road administration in our country is summarized, preparing for the next countermeasures and suggestions; lastly, based upon above analysis, and in combination with the actual status of Gansu Province, the countermeasures and suggestions for improving the rural road administration in Gansu Province is proposed. The research idea of the paper has great reference effect on perfecting the work of the rural road administration in Gansu Province.
