Recently, because of individual government departments and public servants of improper or illegal acts, or cause some disaster accident further deterioration of the phenomenon.Disaster accident not controllable, direct threat to people’s lives and property safety.Proper and effective prevention and treatment of disasters and accidents, and relationship with the level and quality of building a responsible government.In order to control the occurrence of disasters and accidents, improve the responsibility of the government’s ability to build, the concept of accountability in the field of public safety have continued to deepen in recent years.Fire and rescue the serious disasters and accidents caused by the poor, due to the negligence resulted in several firefighters held accountable, and get the corresponding punishment.Thus, implanted accountability is more and more important in the field of fire safety.Fire departments in China are under the leadership of the public security organs and the armed police forces.In carries on the accountability, also need to consider the public security organs and armed forces within different accountability standards.So in the field of fire safety, the author will focus on "hereby" to perfect the legislation pattern, "line" for the local legislation.In addition, the fire control work has the characteristics of variety, technical, sudden.In view of this characteristic, the author thinks that it is necessary to distinguish between accountability in advance (i.e. hidden accountability) and accountability after the event.Because in the infancy of hidden trouble, mainly for the supervision of public media, ignore complaints whistle, improper handling and for the fire law enforcement faced with problems of discretion to exercise the problem such as loss of justice shall be investigated for responsibility.And after the accident the south north regional risk differences between different:the northern climate is dry, the fire, fire work is the key;Southern humid climate, rainfall is large, often mudslides, floods and rescue work is the key.The north and the relief is not timely, accountability standards the author thinks that the problems of the decision-making errors should be treated differently.Thus, although in the local fire safety accountability to the legislative provisions, but there are still many loopholes.Fire safety accountability, rooted in the realistic requirement of responsible government construction, and obtain the rule of law theory support, and form a complete system.But, throughout the recent fire accident, combined with the special system of fire fighting forces in our country, our country legal system of fire control safety accountability are still many deficiencies, embodied in three aspects:one is on fire control safety accountability legislation level is not high;The second is, the elements of fire safety accountability system is not sound;Third is the fire safety accountability system lack of supervision and remedy mechanism.Countries outside the administrative accountability system through the historical practice of inspection have formed a set of relatively perfect operation mechanism and legal system, is different from Chinese legal system, fire fighting system, but the study on fire control safety accountability legal system in China has certain enlightenment function.Therefore, using the experience of other countries, to perfect our fire accountability legislation, and through the perfect supervision mechanism to ensure the effective implementation, has become a perfect our legal system of fire control safety accountability, maintain the necessary choice of people’s life and property safety.
