The Study Of Law On The "Network Democracy" Under The Rule Of Law In China

In 1995, the American scholar Mark Slouka first raised the word "network democracy". In 1996, Barrow first put forward the "network space". In his paper, this place is a beautiful new home like the free thinking of "Utopia".In recent 20 years, with the further advance of the Internet commercialization, we see that the thing brought by the Internet is not all good, also including more and more social problems, legal problems, network democracy problem is one of them. About the concept, characteristics, function and meaning of network democracy all aspects just like the network itself, such as joy and pain or have quite different opinions. But whether it is which kind of thing, it can’t get rid of a consensus, which is the network democracy, along with the network technology is going into daily life. The technology has brought the profound influence on the democracy, and has brought the great test on the rule of law.Despite the introduction and conclusion, this article through four chapters, this paper discusses issues of legal regulation of the network democracy.The first part, through a thorough analysis, the author of this article compare some similar concept,such as "virtual democracy" and "network democracy", clarifying choose the concept of "network democracy". Later, this paper analyzes the connotation of the concept of "the rule of law in China". By analyzing the concept of the above two parts, restore the rule of law in China under the goal of the concept of network democracy.The second part, the article compare the inside present situation of the network democracy with situation in the other countries. And then the author analyses the inside and outside the domain of network democracy legislative status. As a result of the democratic process, the writer further analyzes the problem of network democracy in our country, as well as the causes of these problems.The third part, the article analyze the interaction between the significance of network democracy to the citizens’basic rights by discussing the relationship between the network of democracy and right to know, right to participate, right to express, the right of supervision and the other basic basic rights of citizens. Later the author will show the value of the rule of law in China.The fourth part, this paper tries to explore the path of promoting democracy scientific and stable development of network. Through the network for democracy legal regulation should pay attention to the basic principles of analysis. Further the author will put forward the rights and obligations of citizens that we should pay attention in the network legislation.
