Research On The Regulatory Model And Improvement Countermeasures Of Community Correction In Zhuanghe

As one of the important measures in the penalty system of our country, community correction is a kind of non-confinement penalty system which is widely used all around the world corresponding to the prison system. It takes seven years for our country to make this system carry out from the research to the implement. In this period, many unprecedented breakthroughs were made and also each region gained quite a lot of experiences, but little research has been done on supervision patterns. This dissertation is based on the practice of community correction in Zhuanghe and it begins with the perspectives of ministries of justice. Meanwhile, it analyzes the problems of the community correction supervision which is based on the supervision patterns in Zhuanghe and put forward new proposals as a result.This dissertation includes four parts. The first part talks about the background, the meaning, the terms and the research status of community correction and gives an assumption of how this work develops. The second part analyzes how the secondary supervision works which is based on the situation, the community correction agencies, the members, the procedures and the measures. And also, it finds the problems in legislation, enforcement, operation, effect and agreement and gives the reasons why these problems appeared, including lack of legal ground, paying more attention to control and unscientific measures. The third part gives the details of establishing three-stage supervision patterns with the advanced methods and theories in China and abroad and proves whether the three-stage supervision patterns is feasible based on the conditions, the workers’staffing and managing, the using and consisting of the funds and the expected effect. The forth part gives five suggestions on establishing three-stage supervision patterns, including calling in a specialized team, forming patterns creatively, enhancing the standardization of each organization, making the help of the poor mass practicable and taking full advantage of the Internet.This dissertation is expected to provide the committee, the government and the upper officers of Zhuanghe with several advises and make contributions to the public security through superficially analyzing the patterns of supervision and putting forward some immature suggestions.
