Research On The Legal Issues Of The Grassland Ecological Companion Of Inner Mongolia

Inner Mongolia grassland is one of an important part of the ecological environment system in our country. However, due to the unreasonable human activities and the deterioration of global natural environment, the grassland ecological environment in Inner Mongolia is becoming worse. In order to protect the grassland ecology resources, realize the sustainable development of ecological environment and economic development, our country initially established the legal system of grassland ecological compensation, which plays some good effects. But at present, the law system is still existing some problems, such as the content is not perfect, lack of system, enforcement is not enough and so on. People pay more attention to these problems. In addition, these problems need us analysis the causes, put forward corresponding countermeasures and establish a set of effective grassland ecological compensation mechanism which has become an imperative of new path. In order to promote the sustainable development of grassland region ecological environment.This research begins with the present situation of Inner Mongolia grassland ecological compensation policy, then analysis some problems in the grassland ecological compensation policies and legal system, and put forward the countermeasures, so as to protect and balance the interests in different subjects. In order to discuss in detail, we divide whole passage into seven parts. The first part is introduction that analyzes the research background and the situation in our country and abroad to find the shortages of the existing research and clear about the research’s purpose. The second part is the basic theoretical analysis. In this part, the author give definitions of ecological compensation’s legal connotation, and basic connotation of grassland ecological compensation legal system. It based on the theory of sustainable development, environment theory and the public goods theory, which analysis the basis theory. The third part is the legislative practice analysis. Clarifying the legal framework of grassland ecological compensation(including constitution and relevant laws, administrative regulations, local departmental rules), compensation policies and measures(including eastern area of Hulun Buir grassland and the western area of Wulatezhongqi grassland), and the situation of empirical investigation. The fourth part is the study of legal issues. From three aspects: the grassland ecological compensation legislation, system and law enforcement. Combing the existing problems that mechanism is not sound, the investment and financing mechanism is not perfect, and supervision is week and so on. The fifth part introduce the references of foreign ecological compensation legal system, from the ecological compensation legal system of United States, Germany and Costa Rica to summarized some important enlightenments. The sixth part analysis the legal countermeasures which have been clear about three measures, including the basic principles, put forward consummate the legal system, improve the specific content. Meanwhile,propose some suggestions of legal mechanism, including perfecting the supervision system, introduction of different market trading mechanism, establishing diversified sources of funding mechanism, setting up a scientific and democratic decision-making mechanism and so on. The last part is the conclusion, which summarizes the main ideas and advance the prospects for this study in the future research.
