Research On The Problem Of The Grass-roots Government In The Process Of Land Expropriation

Land as a means of production, provided the space of production and life for living, which is an essential condition for survival and development. In recent years, with the rapid development of economy and the accelerating urbanization process, urban and rural development is also rising demand for land, expropriation of peasant land has become an inevitable trend, so it is bound to generate a large number of landless peasants. The emergence of "landless farmers" is not terrible, but "the problem of landless peasants" can not help but worrying. Grass-roots government as the main part of land expropriation is very closely associated with the farmers. So the behavior of the basic level government in the process of land expropriation which is appropriate or not is not only directly related to the vital interests of landless farmers, but more related to the stable development of the society and the smooth completion of the construction of the well-off society. Therefore, exploring the problem of the grass-roots government in the land acquisition process, and then putting forward the corresponding countermeasures to standardize government’s behavior, is very important to perfect our country current grassroots land expropriation system.Firstly, this thesis expounds the theoretical basis and the related laws and regulations of the land expropriation in our country, and then by introducing the Du Jia Tuan village of "3.21" arson in Pingdu City to analysis the problems of Pingdu City Hall in the process of land acquisition. The main problems are the abuse of expropriation rights, forced evictions and demolitions, buying low and selling high land,lack of transparency in the land expropriation, the resettlement measures after land requisition are not reasonable etc. These are common problems existing in the land acquisition process of grassroots governments in our country.Secondly, by introducing the land acquisition case of Lingshui county government in Hainan, this thesis analyze the innovation of Lingshui county government in land expropriation, the achievements and the enlightenment to improve our local government land acquisition mode. The innovation of Lingshui County government of land expropriation includes resettlements. The former includes formulating a unified high compensation standard of land expropriation, and implementing the green crops attachments to compensate the all-in bundling measures etc, the latter includes the rational allocation of land increment income; giving the landless farmer into full play in land expropriation; carrying out the resettlement ways of "stay in the resettlement" or "land exchange placement" for the long-term development; using a variety of ways to promote re-employment of the land-losing farmers and strengthening social security services etc.Finally, through a comparative analysis of two basic level government land acquisition case above, this article discusses the countermeasures to reform the current grass-roots land expropriation system. The countermeasures mainly include reforming and standardizing the current land expropriation mechanism, perfecting the mechanism of administrative accountability, establishing the "three unification" supervision mechanism of the land expropriation, establishing and perfecting the supervision mechanism of rural land property rights market, establishing and perfecting the rural social security mechanism,in order to standardize the behavior of the grass-roots government land requisition, achieve harmonious legal land expropriation, so as to guarantee the smooth development of city urbanization and successfully completion of building a moderately prosperous society.
