Study On Cohesion Between Development For Poverty Relief And Rural Minimum Living Security System Under The View Of Anti-poverty Legislation

Institution, as standard of behavior when people engaged in social activities and deal with the conduct of social relations, has had a direct and important influence on state organs, social organizations and individual behavior. At anti-poverty angel, our country has built the two wings of anti-poverty system--development for poverty relief and rural minimum living security system, and has obtained certain achievements and experience. But with the advancement of anti-poverty work in our country, it calls the internal requirements of the government in anti-poverty system of perfect and innovation.In recent years, our country has obvious value the legal system construction of the people’s livelihood problems including eliminate poverty, and constantly stressed to anti-poverty work on the orbit of legal system. Legal system construction on poverty in our country is the core of anti-poverty legislation, and at the time of the anti-poverty legislation problems research, the first thing we saw was still two system,development for poverty relief and rural minimum living security system. From the perspective of protecting human rights, the two systems have different focus, the rural minimum living security system focusing on the poor right safeguard, and the development for poverty relief focusing on the protection of the development rights for poor. Since the beginning of the reform and opening in 1978, and with anti-poverty practice in our country, by brewed, sprouted and established, two policy has developed to system, but as they belonged to different departments, the two stranger system-but all roads lead to Rome, spread abroad the anti-poverty resources of our country. Until found in the central committee of the communist party of China and the state council [2010] no. 1 files offered to poverty alleviation and development and the system of rural residents "gradually expand the effective connection of pilot",the linkage between the two systems work began in around the pilot. As a unified logical starting point of the anti-poverty legislation, the linkage between the two systems, has provided practical support for our research anti-poverty legislation.This paper attempts to explore the theory and connotation of the linkage between the two systems from the view of jurisprudence, explore their generation and development from history, and find their lack and deficiency through the analysis of the status quo, then put forward concrete Suggestions for the linkage between the two systems from the angle of the anti-poverty legislation, as well as provides new thoughts for the government’s anti-poverty work.
