A Study On Administrative Law About Government Micro-Blog Standardization

In the 21 st century, science and technology are developing rapidly. The use of new technologies has promoted the rapid development of the e-government, which has brought about great changes to human social production and life style. As a new army of network application, since it is born in China in 2009, just a few years time, government micro-blog has realized a blowout type development, and it has involved an amazing scope and speed. Government micro-blog, which is characterized in that the rapid spread of interactive, timely, convenient operation and low cost, has many functions, such as open government information, provide administrative services, guiding the public opinion and other functions. Therefore, at the beginning of the birth, government micro-blog had gained the favor of many government departments. In the government and its departments, giving full play to the advantages of government micro-blog, will bring together the wisdom of the people, and help understanding them timely, it is very useful for the maintenance and realization of the interests of the people.But the current situation of our government micro-blog is not optimistic. As a way of the publicity of government information, it shall subject to the regulation of ‘The people’s Republic of China Government Information Disclosure Bill’(hereinafter referred to as the ‘Regulations on open government information’). however, its function is not limited to the publicity of government information, resulting in the application of the regulations will be many contradictions; in addition, it still have other problems in the aspect of subject, content, procedures etc.. Fortunately, there are many places had realized the seriousness of the problem, and then they introduced a corresponding specification file. But because no laws, some local files are just principle provisions of rough, some just inconsistent or conflicting provisions; in addition, in the place where has not yet issued normative documents, the government micro-blog is unable to follow, follow one’s inclinations. All these problems are not conducive to the long-term and healthy development of it.This passage takes the government micro-blog rapid development as the background, in-depth research on our country’s government micro-blog. The thesis consists of five parts:The first part, briefly introduces the development of government micro-blog since it was born in our country in 2009, and analyzes its realistic significance in China’s rapid development.The second part, clearly analyzes the reasons why it does not apply "Regulations on open government information" and introduces a few contradiction and performance: it’s subject identification, publishing content, applicable procedures have discrepancy with the regulations; then, discusses in detail that there are several problems still existed, mainly include: its nature is not clear, the interaction between officials and people lacks of procedure and the right infringement happens but the relief mechanism is lack, and so on.The third part, deeply analysis the reason why Chinese government micro-blogs appear fore-mentioned problems. Because there is no widely used law and the consciousness and behavior of relevant social subjects still have some problems.The fourth part, introduces in detail the region outside and inside the successful experience which can be reference for our country government micro-blog standardization. Foreign successful experience with the British government issued the ‘Template Twitter strategy for Government Department’, the United States had took many valid norm measures; the successful experience of domestic are some local government currently has been introduced relatively perfect government micro-blog specification, such as: some local files clearly stipulates the procedures of government micro-blogs. Some give out the provisions of the contents and the division of responsibilities, working mechanism, and some clear the relationship between government micro-blog and other network platform; all these successful practices have very important reference function for Chinese government to promulgate a universality used government micro-blogs specification file.The fifth part, based on detailed analysis,the passage gets an induction and refining on the above content, and then starting from the angle of administrative law, it puts forward several feasible suggestions to our country to develop a generally applicable government micro-blog specification document, mainly include: clear definition, the provisions of its duties and procedures, making a clear operating mechanism, the provisions in the event of tort relief mechanism.
