| Since the date of human beings appeared, poverty has been going hand in hand, today, the material life of human beings has been greatly improved, however, the poverty problem are more severe, which is undoubtedly contrary to the era themes of democracy, development and progress, Poverty has become the enemy of mankind, reducing the poverty is the common vision of humanity.The problem of rural poverty alleviation has been attached great importance since the founding of our country, especially since the beginning of the 1980’s, the Government increased more poverty alleviation efforts, these initiatives have made great achievements, making tens of millions of the poor out of poverty and go to well-off. However, behind the achievements, there have been some new problems, such as, Poverty inefficient, returning to poverty, high default rates and other issues, the reason in one hand is the harsh condition of production, natural resource scarcity, low cultural quality and lacking of insight into the market; in the other hand, the lack of market participation, resulting in insufficient depth and breadth of poverty. For a long time, China’s poverty relief loans only by the Agricultural Bank of China, policy is clear that it is difficult to mobilize the enthusiasm of the poor, and due to the dispersion of the rural market, high-risk, financial institutions is reluctant to get involved in the rural market, and for some financial institutions which involved in poverty-stricken areas are refuse to lend for the reason of unable to provide acceptable collateral. So how to guide the flow of capital and thus enriching the poverty-stricken areas, lower threshold for poor households while reducing the risk of lending has been a top priority.Practice has proved that the introduction of competition in rural poverty reduction is the fundamental way to help the poor out of poverty, then how to do it? In this regard, the foreign advanced experience in this field will undoubtedly provide useful lessons for us, market economy is inseparable from the rule of law, foreign experience tells us that poverty is only well-developed when legal system is founded, and that the poverty reduction can be carried out according to the law. Despite China’s relevant departments have developed a number of pro-poor measures, but the common feature is the lack of rigidity, lower rank and Miscellaneous, it is difficult to effectively implement in practice,Therefore, to develop a unified and authoritative poverty law has become a top priority.On the basis of our existing experience, through the advanced experience of other countries, this paper proposes a preliminary idea of establishing a unified legal system of The Credit Poverty Alleviation. It contains four parts in addition to the introduction and conclusion of this article:Part one: It is an overview of the theoretical, first, it include a brief analysis about the concept of poverty alleviation and related content, the regulation object, Finally, based on data analysis, it illustrates the necessity to build the Credit Poverty Alleviation legal system.Part two: It analyzes the current situation and problems of The Credit Poverty Alleviation, and on this basis, it pointed out the focus on building the legal system of The Credit Poverty Alleviation.Part three: It is a brief introduction to the experience and effects in other countries, and pointed out the reference for the establishing of our Credit Poverty Alleviation legal system.Part four: On the base of the comparison and absorption of foreign beneficial practices, initially proposed the general principles and specific legislative proposals to build our Credit Poverty Alleviation legal system. |
