Research On The Power List System In Perspective Of The Government Functions Transformation

New moves toward reform are proposed in the Third Plenary Session of the Eighteen that “push for the power list system in the Government and its department of all levels and make the operating process clear under the rule of law”. From the perspective of the transformation of the government, this paper summarizes the practices of power list system in recent years. By analyzing the problems and obstacles confronted in push for the power list system, the paper put forward practical and objective proposal.Specifically, the introduction part of the paper does overall description on the background and meaning, status and assessment, research content and framework, and research ideas and method; and the research is generally summarized in the conclusion part on whole; the core part consists four chapters:The basic theory analysis is talked about in the first chapter which consists three parts. The first, which leads to the main theme---research on the power list system from the perspective of transforming government functions, mainly analysis the administrative power from its connotative meaning, origination, characteristic and inter-connection. The second delimits the definition and extension of the power list system and talks about four basic issues about the perceiver and the world, the intention and the aim, basic principles and the its basis. Around setting a good development environment, providing fine public service and safeguard the fairness and justice, the part puts its emphasis on the huge immediate significance for transforming government functions to push for the power list system. It concludes that the government functions can change to a right direction only when the government carry out its functions and solve the problems of “offside”, “vacancy”, and “dislocations”. Generally, aiming to make the problems of the basic definition and relationship clear, the first chapter mainly analysis the basic theory to lead to the next exposition.It analyzes the present situation of the push for the power list system in China in present in the second chapter. Taking Hebei, Zhejiang, Guangzhou as examples and summarizing the practice and effect, the paper thinks that there are three models. The power list system tried out from the local government and the related departments also have done much on this. So, it also introduces some public circumstances of the power list of the state.It analysis the problems and obstacles encountered in the push for the power list in China in the third chapter which puts emphasis on five aspect consisting understanding that is not correct, related legal that do not coordinate, relationships inside and outside of the government do not straighten out, problems of interests collision in rights adjust that is obvious, technology support that is not mature. Through the analysis above, it leads to a conclusion that the push for the power list system would not be smooth, which suggests the policy making department that should have a full preparation that it should be pushed by legal, but also planed discretion and organized with care.It is suggestion analysis on push for the power list system in the fourth chapter. Considering the problems and obstacles in the former chapter, it puts forward some suggestion in this chapter which goes around the ideas of various aspects related, perfecting related legal system, further straightening out the relationships inside outside, resolving the conflict between various aspects in benefit and supplying a technological support.The paper put forward that the closed and vague pattern is the major obstacle that affect the operation and effect of our administration system and its modernization. To form a government function system that is consistent with the China’s actual conditions and the principle that the modern government develops, government of all levels should do what they should do in the frame of constitution and law, giving up the right that they do not have and returning to their own administrative location. So the power list system should be realized and understood in the comprehensive deepening of China’s reform era background and from the perspective of government functions transformation. To make them play their roles correctly in the state and society administration in future, the duty and boundary line, in the interaction between the government and the market, society and citizens, should be made clear. To make the power list system push fully and effectively, the administrative system reformation, as a “self-reformation” which is full of difficulties, obstructions and challenges, must pay attention to the systematic nature, interrelated nature and cooperation nature.
