In China, the appointment system of civil servants position brings a major change in the administrative field of human resource. With the deepening of the pilot project, there springs up large amount of disputes on the issue of personnel system of civil servants appointment system. On the legal basis of Article 100 from "Civil Servant Law", there comes the establishment of disputes settlement mechanism on personnel system of civil servants appointment system. Meanwhile, there are still the deficiencies on both the personnel dispute arbitration authority and the personnel disputes litigation operability. Therefore, it is necessary to have a selection from the western governance experiences for reference, to uphold the principle of procedural justice and judicial final law, to put the personnel disputes arbitration and personnel disputes litigation into (quasi) legal tracks, and to establish a cohesive system of "either to adjudicate or to trial, the administration of justice in final".
