After the formal implementation of the "Labor Contract Law", Labor relations legislation mode has been made tremendous adjustment. Human resource management in many companies also be forced to adjust. SMEs are not able to quickly adapt to the Significant adjustments of the law. Meanwhile, in order to pursue the immediate interests, some companies will choose to avoid the relevant provisions. This will make the deterioration of the employment relationship, This paper analyze the main effects of the labor contract to the SME employment relationship from the perspective of SME employment relationship conflicts and the problems in the labor contract.Firstly, this paper summarized the theory of the employment relationship. It analyzed the current situation and problems of the SME employment relationship, and summarizes the four core contradictions of SME employment relationship. Then analyze its causes and the Signed Status of the SME labor contract. On this basis, it make a questionnaire survey to the SME employees, and using SPSS software to make a statistical analysis, Some information like employee information, enterprise information and the content of the contract are included. use the two dimensions of the employment relationship as the dependent variable, using correlation analysis, ANOVA and so on, Finally reached the conclusions of the impact of the labor contracts to the SME employment relationship.The last part of this paper make suggestions to the implementation of the labor contract system, the signed of the SME labor contract and how to create long-term employment mechanism. First, by summing up the experience of foreign labor contract, Get some inspiration from the aspects of the labor contract system; Secondly, make some suggestions from the aspect of businesses, employees and government. Promote the healthy development of China’s Labor contract process.
