The Study On The Local Government’s Regulation Of The Transfer Of The Use Rights Of Rural Collective Construction Land

In recent years, with the acceleration of the process of the city and the development of enterprises in towns and rural areas,the rural collective construction land, especially the one around the citys and towns is demanded increasingly.This makes the rural collective construction land which is illegal transfers very serious and the disordered circulation brings many difficulties to the work of national land management.The land is different from the general commodity, land problem is an important issue and related to the stability and development of the country and the fundamental interests of farmers. To adapt to the new requirements of the Social development, under the support of national policy, many local governments allow the use rights of rural collective construction land to be transfered.The local government also make some regulations to the manage and supervise it. The regulation of the local government plays a very important role in the implementation of the policies of the central government’s orders, improving the rural collective construction land market and promoting the rural collective construction land use rights transfer orderly. However, due to China’s current rural collective construction land market is still not perfect,and has the problem of market failure and government failure, There are a lot of problems in the local government’s regulation of the transfer of the use right of rural collective construction land and should be improved.This article studies the local government’s regulation of the transfer of the use right of rural collective construction land from four aspects. Firstly, Introduced the related concepts, The main elements,the theoretical basis and the significance of the local government’s regulation of the transfer of the use rights of rural collective land for construction, including the achieved effectiveness,some problems and what is driving these troubles.
