The Research Of People Congress Interpellation System

Theories like popular sovereignty, representative government and power balance are the foundations for the establishment and development of interpellation system. After the development of over two hundred years, interpellation has become one of the supervision means for organs of state power to supervise government. However, from the practical development situation of Chinese constitutionalism, the interpellation system of People’s Congress still needs further improvement. Nowadays, the interpellation system of Chinese People’s Congress has formed a relatively complete legal system which is guided by constitutions, including the laws and regulations such as organization laws for National People’s Congress, organization laws for local people’s congresses and local governments, rules of procedure for Standing Committee of the National People’s Congress, Representation of the People Acts and supervising laws. Even so, there are still many shortcomings in the design of current Chinese interpellation system of People’s Congress. For instance, the specifications on the implementation rules, interpellation procedures and interpellation time are not detailed or practical enough. On the practical aspect of People’s Congress, there are also problems like few interpellation cases and low interpellation transparency. As a result, the National People’s Congress cannot fully play its supervising function of interpellation. The effective operation of interpellation system is of great significance, for it can not only guarantee the dignity of constitutions and laws but also protect the authority of NPC’s supervision as well as the legal operation of national organizations. Therefore, based on suitable to Chinese actual conditions, the further normalization of the NPC interpellation system can refer to the interpellation systems of Western parliaments to make it more popular and stable for application so as to better play the supervising function of NPC. In order to effectively realize the supervising function of NPC, interpellation should arouse extensive concern and researches on supervising modes. There are many reasons for the problems in the NPC interpellation system like traditional culture, political systems, incomplete interpellation laws and regulations. Therefore, to perfect the NPC interpellation system, the traditional political and cultural concepts as well as the restraints of political systems must be removed, the constitutional position of NPC and its standing committee must be implemented and people’s democratic and lawful position must be enhanced. Starting from the basic theories of interpellation system, this paper conducts researches on the NPC interpellation system.
