A Study On The Control Of Transnational Human Trafficking Crime

Human trafficking crime is a serious crime of violation of personal right and personality right. Human trafficking crime has been existed in China from ancient times. In recent years, in addition to geographical advantages, the ASEAN countries and China communicate closely, China and ASEAN member countries close relations increasingly, bilateral personnel exchanges frequently, a new form of crime-transnational human trafficking crime enters people’s field of vision. Therefore, it is an important guarantee to keep Chinese-economic security of ASEAN Free Trade Area and the normal operation of international communication, and it is also an important measure to maintain the social stability in the border area.This paper aims at the analysis of the characteristics of transnational human trafficking through crime and the southwestern China transnational human trafficking crime present situation, so as to explore how to improve the control system of Chinese transnational human trafficking crime. The full text is divided into six parts, the first part is the introduction, introduces the selected topic origin of transnational human trafficking crime, significance of the topic, research status of scholars, and research methods of this article.The second part present the characteristics of transnational crime, combining the social harmfulness of transnational human trafficking are discussed, and compare with the same points discussed in Chinese criminal law, crime of abducting and trafficking in women and children and transnational human trafficking crimes and different points, and points out that the current criminal law of our country is lack of concrete and clear provisions on transnational crime in cognizance, criminal law of our country about transnational human trafficking crimes must be following with the international standards.The third part of the detailed analysis of the background of transnational human trafficking in southwest china. Social factors is economic exchanges increased, regional economic development gap; geographical factor is provided convenient geographical advantage, border management lay hidden dangers; historical factors is that the border area are a nation; psychological factors is that psychological victim and criminal law and policy factors.The fourth part analyzes the existing in crime control of transnational crime in the southwest region of China’s difficult. First of all, legislation to protect the object scope is relatively narrow. Secondly, the crime form of renovation, the difficulty of the investigation. Again, the lack of the victim’s relief afterwards.The fifth part for the fourth part of the face of Chinese transnational human trafficking crime difficulties, combined with the relevant international conventions, draw lessons from western countries and Taiwan region of China’s relevant provisions for transnational trafficking, put forward the corresponding control measures.
