Research On The Function Orientation And Development Direction Of The Township People’s Congress Presidium

National People’s Congress is the highest organ of state power, while Township People’s Congress, as the bottom of state power, is the national representative organ where people can directly participate in the administration and discussion of state affairs. As with the history of institutional changes, the Township People’s Congress Presidium rises in a proper time, following the implement of our Constitution and the implement and reformation of National People’s Congress system.Among various levels of People’s Congress Institution, the Township People’s Congress Presidium is so special that its character and function are different from those of Standing Committees at or above the county level. At the same time, there are differences in the operation mechanism between Township People’s Congress Presidium and its above levels. At present, the Township People’s Congress Presidium has become a basic system in realizing the mutual communication between national administration and public demands in our present system. According to some local provisions as Working Regulation of Township People’s Congress and Provisions of Township People’s Congress Presidium, combining with the practical operation of Township People’s Congress Presidium, the Township People’s Congress Presidium objectively executes various functions and power of Township People’s Congress in the recess period of the Township People’s Congress. The problem is that in China, People’s Congress in various levels are not Permanent Institution, it is the Standing Committee above county level that takes charge of daily routines of People’s Congress, while Township People’s Congress Presidium does not possess the same rights and functions with those of the Standing Committee at the same level. Therefore, the function of Township People’s Congress seems barren and ambiguous. The problems such as the relationship between People’s Congress, the Party Committee at the same level and government are quite obvious in the operation period of Township People’s Congress Presidium.Consequently, in the structure of our fundamental regime, the argument in academic circles that whether the Township People’s Congress Presidium should exist or not has never ceased. From our present system, national and people’s conditions, and on the basis of the practical condition of our fundamental regime, the improvement of our People’s Congress system will experience a certain process. On the trend of the construction and development of the Township People’s Congress Presidium, at first the orientation shall be explicit and relevant system regulations shall be improved. At the same time, the law relationship with the relevant subjects shall be cleared and its legal responsibility shall be strengthened while performing its functions.
