Perfection Of Legal System Cleaner Production

High-speed development of the world economy has brought seriousenvironmental pollution and ecological destruction, especially our economies intransition, and economic development will inevitably bring high pollution,environmental issues become increasingly prominent. Eighteen years,"five in one"put forward thinking, eco-construction has been put on the agenda, the state policiesand regulations are increasingly concerned about environmental issues and ecologicalproblems. In all existing environmental problems, particularly severe industrialpollution, which is the traditional industrial production challenges, forcing companiesin the pursuit of economic profit at the same time have to consider the impact of theirown living environment of the surrounding environment, and actively seek a new wayto be able to take into account the economic, environmental and social benefits. Intoday’s context of the concept of circular economy, clean production (CleanerProduction) to mark more and more. Cleaner production means: the comprehensivepreventive environmental strategy applied to industrial enterprises continued toimprove the utilization of resources and energy, reduce pollution, to reduce the risk tohumans and the environment.China’s current economic development is still largely follow the traditionalextensive management model to achieve rapid economic development in the largepopulation base, fewer resources, economic and technological level are relativelybackward conditions, especially the rapid development of large-scale industrializationand urbanization, coupled with environmental legal system is not perfect, the way theend of the pollutant treatment of weak law enforcement, and that is bad legislationand enforcement of low status, resulting in environmental pollution and ecologicaldestruction increasingly serious environmental problems in general. The cleaner production is to achieve sustainable development strategy of China’s inevitable choiceboth economic and ecological benefits and win-win strategy. Advanced cleanproduction experience shows that relying on market mechanisms cleaner productionpulling power is very limited, promote clean production needs to be implemented bythe national law of conscious regulation. However, currently produces clean ourresearch is still just focused on technology and management, research on legal policyis very weak, and therefore an urgent need to strengthen the research on China’s legalsystem cleaner production, in order to provide theoretical support for the legislativeactivities to make it more standardized,operability. Better promote cleaner productionand sustainable development of our business.In this paper, to implement the2012"Clean Promotion Law" as a benchmarkstudy of cleaner production to further improve the legal system, in addition to thepreamble and conclusion is divided into four chapters.The first chapter on the basis of academic experts and practitioners on theresearch findings, summed up the legal definition of cleaner production, cleanerproduction made a preliminary introduction, clear clean production itself withuniqueness. And describes the implementation of cleaner production legal systempractical necessity, the main argument from the perspective of incentives, economicanalysis and practical significance in three areas.The second chapter describes the legislative review of cleaner production, andthe status and deficiencies of the existing legal system cleaner production, mainly inthe imperfect laws and regulations is not complete, management policies are notstandardized, the economic aspects of the lack of institutional and technical policiesso non-uniform aspect.The third chapter introduces the advanced experience of some Western countries(USA, Germany, Japan) clean production legal system, and its corresponding review,summary.The fourth chapter presents some of the cleaner production sound legal systemsuggestions, including: legislative level; management level; economic level;institutional level; technical level, and so on.
