Legal System In China Cleaner Production

In the last few years, Cleaner Production has gradually become a new trend in theglobal environmental protection. More and more western developed countries haveresearched on the legislation of Cleaner Productions and put it to the most important placeof pollution prevention. At the same time in China, the pollution prevention is not reallyapplied to the enterprise production, but more focused on the terminal-treatment andstandard drainage policy. The ideology of pollution prevention is not clarify in China’senvironmental protection laws，regulation and policies. Presently, there is only oneencouraging law about Cleaner Production in China, the Promotion Law on CleanerProduction, which mark the initial formation of China’s Cleaner Production legal system.In2012the Promotion Law on Cleaner Production has been first amended that makes acertain improvement, but still has some seriously inadequacies. With the development ofthe economy, the industry pollutant emission not only cause a great harm to theenvironment, bus also become a seriously threat to human health. In order to fundamentallyto solve environment problems and turn from the harm into a benefit, we must change ourmind, pay more attention to pollution prevention than terminal-treatment, improve CleanerProduction law and regulations，prevent pollution from the very beginning.In this paper there are seven chapters. Under the guide of basic theory ofenvironmental and resources law, this paper describe the concept and background ofCleaner Production, and define it. Using the experience of foreign countries on CleanerProduction, combining our current situation and law and regulation, this paper trying toanalysis our existed problems and legal defect on Cleaner Production and to offer rationalsuggestions. I truly hope this paper can be helpful on developing China’s CleanerProduction.
