Study On The Legal System Of Agricultural Cleaner Production In China

Agriculture, as the lifeline of the national economy, promotes and safeguards the social development and progress.As we all known, agricultural resources are not inexhaustible and boundless. The recent years witnessed a large of number of problems going more and more serious, such as desertification, water and soil erosion, agricultural chemical pollution, fertilizer pollution and food safety, etc, bringing severe challenges for the development of agriculture in China. The traditional mode of production with high consumption, high pollution and low quality has seriously restricted the sustainable and healthy development of agriculture. Promoting the cleaner production to expand from industry to agriculture and implementing agricultural cleaner production is the only way to achieve the scientific outlook on the harmonious development of environment and resources while ensuring the sustainable development of agriculture. The agricultural cleaner production, adhering to the principle of environmental protection to the end, is capable of reducing and eliminating pollution from the source, thus it is regarded as the necessary measure to prevent non-point source pollution and destroy the "Green Barriers" and it is also the development trend of agriculture across the world in the future.The agricultural cleaner production in China starts late and it is now in the exploratory and practice stage. As for the research on agricultural cleaner production, scholars focus on supporting theories, composition of technical system and management system, paying less attention to the research from the perspective of legal system. This thesis will, based on the research on the concept, connotation, necessity for development and status quo concerning agricultural cleaner production, elaborate the present situation of legal system of agricultural cleaner production in China, explore the existing problems in terms of legal system in a deep-going way and dig the defects and flaws in the development of agricultural cleaner production currently in the legal level. Then, by virtue of analyzing the present situation of legal system abroad and referring to their mature theories and successful experiences, this thesis will put forward the suggestions to improve the legal system for agricultural cleaner production in China. The promotion of agricultural cleaner production plays a decisive role for China to achieve sustainable development of agriculture. As a result, a complete legal system for agricultural cleaner production will provide legal protection for the promotion of agricultural cleaner production and is of great realistic significance.
