With the aging of our population and the deepening of the reform of governmentmanagement system, China’s social welfare system has been further developed. In thiscontext, China’s private pension institutions come into being, and gradually developand grow stronger. The generation of private pension institutions not only eases theenormous pressure of the aging of population, but also makes up for the shortcomingsof public pension institutions in quantity and quality. They can play a crucial role forthe development of pension institutions.Private pension institutions not only have the nature of enterprise, but also havethe property of social public welfare. The quality of its development, not onlyconcerns the institutions’ own long-term development, but also concerns the stabilityand harmony of society. However, China’s private pension institutions develop with alate starting, which still exist many problems in the supporting construction ofhardware and software. Coupled with the various constraints of external environment,resulting them to a struggling on the developmenting road. Therefore, the governmentand society must give them strong support, especially using means of law to protectthe normal development of private pension institutions, and create a favorable legalenvironment for their development.This article consists of five parts. The first part is introduction, which contains abrief explanation of the background and, significance, methods, and content of theresearch,and its innovation. The second part is a detailed overview of private pension institutions, including its definition, the comparison with the public pensioninstitutions, and the necessity of protecting it by laws. The third part introduces thecurrent situation of China’s legal protection for private pension institutionsis, so as tofind out the problems of legal protection. The fourth part introduces the developmentstatus of foreign pension institutions and its advanced experience of legal protection,in order to gain inspirations. The fifth part aims at the legal problems of China’sprivate pension institutions, giving suggestions of well-established legal protection.
