The3rd Plenum of the18th Communist Party of China introduces a lot of proposals, setting up State Security Council is one of them. This council’s responsibility is to improve national security state and strategy, and to ensure country’s safety. It is the biggest highlight that being one of the two new departments in this Plenum. Compared with foreign national security council which is already exists, how to position the State Security Council of China? How to operate it? And what is its legal basis? We all don’t know. This paper is to start with the position and responsibility of the State Security Council,analyzing its definition and position in China, and its differences and relations from other national security departments. Based on the reasons of power, citizen and authority, to explain the State Security Council, as a new national institutions, must be regulation by law. Furthermore, this paper is to learn from the legal regulation of the America, Russia, Japan and other country’s state security council, and to combine with the practical circumstances in our country, proposing some reasonable suggestions, from the amendment of Constitution and Law-making, about the State Security Council being regulation. Currently, China is in transition period and facing the increasingly complex international environment. I hope this article, through other countries’national security council’s practical experience of legal regulation, absorbing those accordance with our national conditions’practical experience, can have a certain reference value to the future legislation of China’s State Security Council.
