A Research On The Incentive Issues Of The Agricultural Comprehensive Law Enforcement

Agricultural comprehensive law enforcement is an important revolution and innovationon the agricultural administrative law enforcement system. For the past few years, theagricultural system of Sichuan Province has made great efforts to the comprehensive lawenforcement and has obtained obvious effect on the law enforcement. However, as thecomprehensive law enforcement being promoted, there occurs some problems. For example,situations in the law enforcement varies, some law enforcement agencies deal with few cases,some even no case, and in the cases, the quality of large amount of files is low, some evenunqualified. These problems are due to the reluctance, passivity and ineffectiveness in somelaw enforcement agencies and personnel. The existence of these problems is closely related tothe malfunction of the incentive mechanism of the agricultural comprehensive lawenforcement. The research on the incentive issues in the agricultural comprehensive lawenforcement is helpful to perfect the incentive mechanism, improve the activeness andpositivity, promote the effectiveness and level of the agricultural comprehensive lawenforcement, thus improve the level of administration according to law in the agriculturaldepartment, and maintain a good market order and the legal rights for the people.This paper has consulted and studied several books and papers relevant to administrativelaw enforcement and incentive theory. Based on the specificity of agricultural administrativelaw enforcement and the specific situation of Sichuan, the paper does a research on theincentive issues of agricultural comprehensive law enforcement. This paper mainly includesfour parts. The first part introduces literature review on administrative law enforcement andincentive theory. The second part researches the current situation of agriculturalcomprehensive law enforcement in Sichuan province, and analyzes the problems existing inthe incentive mechanism of agricultural comprehensive law enforcement are deviation of theincentive target, lacking and inequity of the incentive. The third part analyzes the deepreason for the problems existing in the incentive mechanism of agricultural comprehensivelaw enforcement from two angles: the law enforcement department and the personnel, thus,gets the thought that the pursuing of the benefit maximization by the law enforcementdepartment, the leader and the law-enforcement personnel is the reason for the incentiveproblems in the agricultural comprehensive law enforcement. In the fourth part, based on theanalysis above, combining the author’s work reality, the paper proposes solutions including improving the systems of the law-enforcement input, the performance assessment, the jobpromotion, the salary, strengthening the law-enforcement supervision, carrying out effectivetraining, etc., so as to provide some ideas and suggestions to perfect the incentive mechanismof the agricultural comprehensive law enforcement.
