In modern society, Employment, which is related closely with survive, has become thebasic rights of human aspirations, at the same time, promoting employment becomes a majormission shouldered by governments. In the year of2008, our country has carried out The Actof Promoting Employment which committed to expanding employment, but the oversupply inthe labor market has not been completely changed, the employment situation remains grim.In this context, Flexible employment, which is low threshold, large inclusive, flexible,have created a lot of employment opportunities, on the one hand, absorb the labor force, onthe other hand meet the flexibility labor needs of employer, and also help to reduceunemployment and promote social stability. However, Serious imbalance exist in therelationship of Flexible employment, one just remand a job to survive available, the other tryhard to reduce labor costs, turns out so many infringements on flexible employment laborrights. So it is necessary and significant to protection the labor rights of Flexible employment.In the introductory part, discusses the background of the emergence and development offlexible employment and the significance of flexible employment of labor rights protectionresearch firstly, and then, briefly pointed out the articles related literature review, innovationsand deficiency.The first part, put forward the concept of flexible employment from a comparativeperspective firstly, then from a different perspective on the type of flexible employmentdivide, finally, discuss the characteristics of flexible employment analysis from theperspective of the body.The second part based on the definition of flexible employment on labor rights, summarythe reality of the phenomenon of violation of their labor rights, and then pointed out that theprotection of labor rights constraints.The third part from the constraints, propose a thinking, which complex improving thesocial management system, sounding legal mechanism labor and improving the quality offlexible employment, especially on three levels of legislation, law enforcement and judicial,highlights the role of sound legal mechanism labor.
