In recent years, the phenomenon of excessive packaging of goods becomes are becomingmore and more serious, and caused by the waste of the energy and resources andenvironmental pollution. which not only is hindering the development of our economy, andrunning counter to the construction of a resource-saving society and beautiful China goal.Although our country has introduced the relevant national standards, laws and regulations,and get some achievements in the governance of goods’ excessive packaging, But due to thecurrent laws with only principled provisions, which are insufficient to curb the problems ofgoods’ excessive packaging. Throughout regulations and achievements in Germany, Japanand other countries to restrict excessive packaging, to build a complete legal system to form aunified standard and to regulate reasonably on the goods’ excessive packaging is a moreeffective way. In view of this, it is necessary to complete and perfect China’s legal system ongoods’ excessive packaging based on the foreign advanced legislative experience and ournational real, to provides a system guarantee to curb the problems of goods’ excessivepackaging, and so as to promote the environmental protection in process and construct thebeauty of China. Therefore, this article focuses on how to build a legal system to restrictexcessive packaging of goods in China.This paper consists of five parts, as follows:The first part is a general summary of goods’ excessive packaging, from the aspects ofconcepts, the present situation, causes and the harms, in order to provide objective basis forthe restriction of goods’ excessive packaging by analyzing and exploring.The second part specifically analyze the current development of related policies, laws,regulations about the restriction of goods’ excessive packaging in China, aiming to find outthe deficiencies and defects in our country legal system.The third part inspects the overseas legal system of restricting goods’ excessivepackaging, Focusing on the analysis of legal systems and achievements in countries such asGermany, Japan and the United States. Summarize the commonness, individuality and thedevelopment trend of the legal systems in those countries, to draw inspirations for buildingthe legal system in China.The fourth part introduces the recycling economy, environmental ethics, extendedproducer responsibility theory, and its current situation as the theoretical guide and realitybasis for the promotion of restricting the goods’ excessive packaging. The fifth part explores specific ways to establish and perfect the legal system ofrestricting goods’ excessive packaging in China. By taking successful examples from foreigncountries, the theory of Circular Economy and have an eye on current situation, to built apractical legal system for restricting goods’ excessive packaging.
