Research On The Legal System Of Overpackaging Supervision In China

China is the second largest producer of packaging products in the world,but the excessive packaging of goods is serious.The current laws and regulations of our country only embody the spirit and have no practical operation.To this end,the state issued a series of mandatory standards,some local governments formulated local laws and regulations.However,Mandatory standards are only for special commodities,they are not extensive;local laws and regulations,because of geographical differences,do not have universality,can not be fully and effectively supervise the phenomenon of over-packaging of commodities.Therefore,on the basis of a comprehensive investigation of the foreign advanced regulatory legal system,and in combination with the actual particularity of our country,it is of great practical significance to improve the supervision system of excessive packaging in China.This article first from the concept of definition,form of expression and classification of two aspects of the over-packaging of goods,to provide an objective basis for the following.Secondly,we use economics knowledge to analyze the origin of excessive packaging from the aspects of market analysis,including supply and demand,external,information asymmetry,cultural analysis,regulatory legislation and government failure.Third,from the theoretical basis and practical basis of the analysis of the necessity,pointed out that the excessive packaging of supervision of the legislative situation in our country and the existing problems,such as lack of clear legislative guidelines,special legalissues and legal responsibility,the regulatory body is unknown,fuzzy authorization authority division is not clear.Fourth,the study of foreign legal system of the supervision of excessive packaging of goods from the legislative and legislative guiding ideology,concept definition,the judgment standard,the supervision of the main body,the main responsibility and authority,supervision measures and methods,legal responsibilities and other aspects,summarizes the commonness and individuality and development trend.Finally,according to the reality of our country,the establishment of sound laws and regulations of the supervision of excessive packaging through comprehensive legislation and special legislation,clear the principles of legislation,supervision of the main body and the main responsibility and authority,the specific supervision system and legal liability type,establish public interest litigation and the procedure of anti unfair competition and other measures to improve our excessive packaging of goods supervision legal system provides some feasible suggestions.
