Research On Evaluation System Of Major Administrative Decision By Local Government

It is presented on the report of Eighteenth National Congress of the Communist Party ofChina that “Ruling by laws is the basic method of governance”,“Insist on decision making byscience, democracy and legislation, improve system and procedure of decision making, makeuse of think tanks, establish and develop the policy of accountability and correction. Anydecision related to the masses’ interest should be based on the masses’ opinion, and anythingcould damage the interest of the masses should be stopped and corrected stoutly…”. It is alsopointed out on the Third Plenary Session of the Eighteenth Central Committee of theCommunist Party of China that “In order to construct jural China, it should be insisted thatpromoting governing by law, ruling by law and administrating by law simultaneously andbuilding a nation of laws, a government of laws and society of laws all in one”,“Improve thesystem of auditing the legality of regulating documents and major decisions”…Establishingand developing lawful, scientific and democratic decision making system has become to oneof major goals of government self-constructing and management system reforming. In orderto achieve magnificent goal of all-round well-off society, built a lawful governmentfundamentally has become a goal on legislation under the general goal. As in the level ofgovernment management, one of the crucial contents is insisting on decision making relyingon science, democracy and law and improving system and procedure of decision making.Through years promoting administrating by law, a great improment has been achieved onscientific, democratic and lawful major decision making by local government, but severalproblems still remained. This paper start from the evaluation system on major administrativedecision of local government, through analyzing principle, characteristic, effect, standard andcontent, associating specific cases to study in problems still existed, such as lacking ofsufficient pre-decision estimation, dynamic in-decision evaluation and post-decisionaccountability. Based on typical represents of US and Japan as foreign evaluation system onmajor administrative decision, analyze and find the path to improve evaluation system onmajor administrative decision of local government. Through Improving pre-decisionestimation, such as masses involving and expert discussion, focusing on in-decision dynamicevaluation, such as supplement and correction evaluation, strengthening post-decisionaccountability, such as supervised by the National People’s Congress (NPC), the ChinesePeople’s Political Consultative Conference (C.P.P.C.C.), and the society and accusing responsibility, the scientific, democratic and ruling by law decision making system will beeventually formed.
