Research On The Construction Of Civil Legal System Of Ecological Civilization

Ecological civilization is a hot topic in modern society, it adapts to the change and summon,and constantly put forward new requirements, among them, ecological legal system is animportant symbol of modern society. The civil law system of ecology is one of the importantaspects. It can not only make up the shortage and defects of public law and administrativemeasures in the governance of environmental problems, at the same time,it also can play theprivate law function of environment protection, it is beneficial to make the concept of ecologicalcivilization penetrate into the heart of every citizen more quickly and deeply. At the same time,the requirements of our citizens on the comfort level of ecological environment are also rising,which provide an opportunity for our legislature and the relevant administrative departments toreform and improve the law enforcement capacity on ecological environment.On the basis of ecological civilization construction on the18th CPC National Congress, the4th Plenary Session of the18th CPC National Congress proposed a central theme “the rule oflaw”, and the announcement put forward that prosecution add public interest litigation as its newfunction, which offer a good opportunity to make an ecological civil law by institutionalizationand legalization. The main purpose of this paper put the concept of ecological civilizationproposed on the18th CPC National Congress as the core of the value, combine with the spirit ofpromoting the rule of law, proposed on the4th Plenary Session of the18th CPC NationalCongress, and then from the perspective of the civil law system to provide consideration andadvice in the field of law for the realization of ecological civilization.The article proposes the connotation and necessity of the ecological civil law system fromthe perspective of the theory connotation, the implementation process, system requirements onecological civilization construction. In the aspect of protecting the civil law system, from theconnotation extension of the fundamental principle of the civil law, the Real Right Law, the tortlaw and contract law and some other perspectives to analyze the protective way of the ecologicalcivil law system. At the same time, consult the contrast the ecological civil law theory andlegislation research from representative countries, such as Europe, USA, Japan, etc. And providethe reference from them to set up the ecological civil law system in our country. Through the analysis of the current civil law system in our country, proposing the content, route, realizationmode for the ecological civil law system. The ecological civil law system is not only escort thepromotion and practice of the theory of ecological civilization construction, but also enrich theconnotation of the theory of ecological civilization construction in the process of legal evolution,finally, protecting the successful realization of the ecological civil rights.
