Research On The Emergence And Development Of The Chinese Communist Party’s Ruling-by-law

The rule of law,as a way of managing state affairs, is an important tool for value.The rule of law is the modernization of the country’s target of choice in managing state affairs, but also an important sign of progress in modern society.The rule of law plays an irreplaceable role in the proper handling contradictions among the people and other social contradictions, and properly coordinate the interests of all sectors to achieve social fairness and justice, building a socialist harmonious society.Communist Party of China is the country’s ruling party, the idea is to achieve rule of law and building a guiding principle of the rule of law.How to build a road of socialist rule of law in line with Chinese practice, resolve conflicts currently in a period of social change, it has become an urgent task facing us.Thus, researching and studying of the Communist Party of China’s Rule of law Thought is very significant.This paper will undertake study from the basic concepts of the theory to ideology of the rule of law firstly. Then analyzing the ideological content of ruling-by-law thought of Marx, Engels and Lenin, and combining the three main stages of Chinese Communist Party’s development and change of ruling-by-law thought. The first stage is from the generation of Chinese Communist Party to the reform and opening in 1978, this stage mainly represented by Mao Zedong Thought, it is a exploration stage of the rule of law to the Communists. The thought of second stage mainly represented by Deng Xiaoping Theory after reform and opening up in 1978, it is the transformation stage from legal system to the rule of law, the initial formation of the ruling-by-law thought. The third stage is the new development of ruling-by-law thought combines period features in the new era. Finally, objectivly analyzing and summarizing the generality of development and the practical experience of the Chinese Communist Party,including persistence in the leadership of the Chinese Communist Party, attaching great importance to the rule of law, and the harmonious development of democracy the rule of law and markert economy, simultaneously, strengthening the rule of law in the exercise of power, to carry out a comprehensive education and enhance the citizens’concept of rule of law.However the structure of core content is the core of all sub-structures. This requires us to highlight the structural characteristics of core content of Marxism. This is the foundation of further study of the other structure, it is also the most effective Way to show the overall characteristics of Marxism, only in this way can we "Back to Marxism".
