| "Migrant workers" is not a formal legal concept, it’s the product of the household registration system. "Migrant workers" is a special combination of whose profession is "workers" and status " is farmer". In the new era of reform and opening up, migrant workers are an important part of China’s industrial workers, they made great contributions on social development of the city. However, due to the household registration system and suppress urban and rural social management system, migrant workers subject to various restrictions in urban employment. Current situation on the legal protection of migrant workers is not optimistic, such as low wages and often in arrears, unfair employment opportunities, poor working environment, lack of labor protection, lack of social security, etc., which make migrant workers become vulnerable groups of workers. At this stage the issue of migrant workers is an social problem that we need a long-term focus and solve. This is not only a necessary requirement on the legal principle of equality, but also the proper meaning of a harmonious society. It is worth considering how to effectively protect the labor rights of migrant workers from a legal perspective.
