Affordable housing system refers to the government in order to meet the housing difficulties of low-income families and the stable work requirements for migrant workers, help and support them to live in a system to distribution, sales, rental subsidies, etc., is an important part of social security system in China. China’s affordable housing mainly include: the low-rent housing, public rental housing, economical and applicable housing, price-limited housing. With the development of the housing market, economical and applicable housing gradually withdraw from the affordable housing market, public rental housing and low-rent housing will be referred as public rental housing. Simultaneously, the rented housing can be rented or sold, sales model appeared in the common property of this situation, this paper tries to study the affordable housing’s real rights, with its property obtained, changes and elimination.Because of the lack of affordable housing system of the property changes about real right legislation, so according to the change of the real rights of commodity housing, and the principle of the real rights law theory, with these we can study the changes of the real rights of affordable housing. But based on the "limited property rights", "rent-to-sale", "common property" and other special specification, affordable housing is not the same rules as commodity housing. There are existed several issues when we analyzed the theory of the real rights changes. At the same time, with the evolving role of affordable housing policy, "use methods in line with local circumstances", "the policy planning is closely aligned but not yet fully integrated" has become the country’s affordable housing policy development trends, so there has the theoretical foundation in adoption of specific laws with affordable housing the real rights changes.This paper is divided into five parts: In the first place, the main contents include: the summary of affordable housing of the real rights of changes. Through the concept of affordable housing, the summary of the legal characteristics, analysis of the structure of affordable housing’s real rights changes between the property housing and the rental housing; The next, brief analysis of affordable housing property obtained. From the different type of suitable properties to rent or buy, we can analyze the property affordable housing’s property obtained, from the different type of funding modalities, we can analyze the rental affordable housing’s property obtained; Once more, We will focus on analyzing about the system of the affordable housing changes. Not only because of changes in property rights related to the main intention expressed, but also involves multiple peremptory norms, we should analyze affordable housing the real rights changes about economical and applicable housing, price-limited housing, the low-rent housing, public rental housing, common property housing, respectively, with a twofold purpose in distribution and transaction, and the other important legal issues in marriage, inheritance, limited property rights, the bona fide acquisition in-depth analysis on the particular situation; What is more, affordable housing’s elimination.an analysis of right to the use of land for construction continue expiration of time limit and eliminate, and eliminated by the exit mechanisms; Finally, for affordable housing the real rights changes were reviewed, presented to use methods in line with local circumstances, and gradually promote the improvement of affordable housing legal advice.
