| Sun yat-sen’s thought of constitutionalism is crystallization of wisdom which comes from the Chinese modern intellectuals. The studies about it mainly are some kind objective descriptions based on the historical material. This paper from the perspective of political science tries to use Legitimacy Analysis as a value tool to analyze Sun yat-sen’s thought of constitutionalism.The Visual threshold of legitimacy should not only include the static concept of legitimacy itself, but also contain the demands from the dynamic political development in practice. In this paper the investigation about background of sun yat-sen’s constitutional thought reveals the reality of the Chinese national conditions in that time, which reflects the sun yat-sen’s constitutional thought catered the urgent needs of Chinese people in that time from the politics. At the same time, this paper explores the political value of legitimacy in the sovereignty of the people and political equal which existed in sun yat-sen’s constitutional thought. This paper also explores the effectiveness of the system designed by Sun which system is considered to be showed the legitimacy. Through the analysis of all the above, we can know Sun yat-sen’s constitutional thought itself defects and environmental restrictions of the implementation of the political idea.By analyzing the legitimacy of constitutional thought of Sun Yat-sen, we could be aware that Sun’s Constitutional Culture mixed with Chinese culture and western culture in the process of communication and socialization happened in China will produce a series of contradictions and conflicts because of Chinese environmental constraints and limits of culture itself. These contradictions and conflicts make constitutionalism as a political culture in the evolution of China’s political development which should be conservative and radical. Constitutional construction is a continuous process which will take some time to carry out. |
