Exploration And Innovation On Community Correction Mode

As the corresponding execution and prison correction, the appearance and development of community correction to reveal the change of history of human society, what is more is the wheel of human history from barbarism to civilization, from ignorance to one of the performance of scientific advance. China’s community correction gate starts in 2003, after the implementation of twelve or thirteen year pilot, and exploration, especially since 2011 formally into the criminal code, and the community correction measures are promulgated in 2012, our community correction has obtained certain result, Beijing, Shanghai and other places also formed a unique model of correction. But compared with the foreign mature and advanced idea and the system of community correction, community correction in our country also exists many problems during the operation, need to be improved and progress gradually.As a community correction work for many years engaged in grass-roots judicial assistants, the author try to elaborate from the origin and the theoretical basis of community correction, comparison and analysis of domestic and foreign community correction mode, and taking the Ou Dong new area correction in the city of Wenzhou as an example, in-depth analysis of the root of the question from China’s community correction work, and then put forword some suggestions on the innovation of community correction mode. This thesis is divided into three parts: the introduction,the main content and the conclusion. The original intention of the introduction part writing is mainly from the significance of the topic and the research background. And collected a large number of domestic and foreign literature, to lay the foundation for the next step of writing. For example, I get the theoretical basis and the origin of community correction from the foreign literature, and master Chinese scholars insights from the domestic literature. The last part of the thesis is the conclusion. The second part is the main content which is divided into three chapters.The first chapter: the related theoretical basis of community correction. This chapter simple introduces the concept of community correction, the development history of community correction, and the domestic and foreign community correction mode. The second chapter: the present situation and problems of Community Correction – take Ou Dong New area as an example. This chapter takes Ou Dong new district as an example, analyse the root causes of problems of community correction work effectively, based on the general situation, main problems from the area of community correction work. The third chapter: Community Correction exploration and innovation mode. This chapter suggest, establish "Chinese mode" of community correction, which is in order to protect the public safety as a fundamental, and in order to prevent the crime as the ultimate goal, on the basis of the advantage of from Beijing Shanghai model and the foreign advanced ideas. And the suggestion for the innovation of community correction mode from three aspects: the strengthening of community correction power, the improvement of correction management system, and the establinshing of ‘to help promote the straightening’ system,based on the "law according to, people-oriented, social participation and maintain the stability of" of the four major principles.
