Research Of Building A Law Service System In The Rural Area

At present, a series of reforms and changes including a change from a traditional society to a modern society, from an agriculture-led society to an industry-led one, from the planned economy to the market economy society is undergoing in the social system in China. These reforms and changes have not only helped the speedy growth of economy buts also produced many problems and contradictions to the society in China today. For example, the poverty gap between the rural and the city has become bigger and bigger, and the process of legalization remains imbalanced. At present the rural population accounts for 80% of the total population of China, of which the poverty-stricken population accounts 66.66% of the total population of China. So the critical point to administrate the state by law is in the rural areas. Much progress in systemization and standardization has achieved in the building of the existed law system in the rural, compared to that of the past period. But its defects are becoming more and more eminent. Moreover some fields have not been adapted to the new situations in the new development trend. Today law service deficiency mostly exists in the rural areas. The farmers’rights and interests can not be protected and guaranteed. Therefore to it becomes a critical issue to promote and perfect the law service system in the rural area. The law service assurance can be realized for the massive farmers and rural resident populations only when the construction of a law service system in the rural area is put into systemized, standardized law system.This paper based on the research and survey of the law service in the rural areas in China makes an analysis to the current situations of the law service in the rural areas in Ruian city of Zhejiang province, using the method of case analysis. Finally it put forward the actual measures to solve such problems and perfect the law service in the rural areas. Thus it has made the conclusions as follows.In Ruian City of Zhejiang Province, The law service includes people’s mediation, attorney service, law aid, notarial services, etc. With the growing development of economy in the rural in Ruian, there remain strong needs for law service. The writer found out that there exist many problems including narrower range of law service, single mode of legal litigation settlement, nonscientific setups of the law service institutions and relative lack of law servants through research. The writer further makes an analysis to the causes of such problems from the aspects including legal consciousness, higher litigation cost, shortage of law service funds, poor practitioner’s environment and lack of state law guarantee. Finally it focuses on how to improve law consciousness, to reduce farmer’s litigation cost, to expand service fund sources and law service channels, enhance the servant allocation and improve the law performance and enforcement effective in order to solve the farmer’s "litigation difficulty.
