In recent years, in order to strengthen the development, utilization and management ofthe ocean, and protecting marine environment and resources, many coastal countriesand regions in the world are strengthening marine management legislation andenhancing the control of the ocean. These phenomena provide China marinemanagement career an example of legislative, but at the same time, China’s maritimesovereignty also face the growing challenge. China’s marine management activitieshave some long-standing problem of the ocean administrative enforcement authorityunclear, in the face of these questions, we should be more accurate and detailed graspof the status of the legal system of China’s marine management, in line with China’snational conditions and learn from outstanding foreign and legislative and lawenforcement experience, efforts to make up for our lack of marine managementlegislation, optimizing the management of our ocean. Therefore, this papersummarizes the major maritime countries in the area of marine law enforcementpractices, comparative analysis and other research methods, combined with the spiritof the Constitution, aims to deepen the perspective of constitutional impediments ofChina’s marine management legislation and marine management system for furtherdevelopment Recognizing the problem, and by deepening the understanding of ourcomprehensive marine management recommendations.The first chapter of this article is to understanding of the marine management system.The second chapter will summarize the contemporary maritime nation oceanmanagement mode, select the United States and Europe Japan and South Korea, inexplaining their marine policy and law on the basis of their domestic marine lawenforcement management system to in-depth analysis and summarizes their marinemanagement system. The third chapter will summarize contemporary marine nationalmarine management mode, selecting the United States and Japan and South Korea,explaining theirs marine policy and law based on their domestic marine law, at thesame time, in-depth analysis and summarizes ours marine management system. Theforth chapter indicates our future dealing with the fundamental guiding ideology andmethods of marine administration, integrated and holistic, hierarchically integratedmanagement of marine affairs.
